Each Financial Valuation includes a corresponding Technical Evaluation to assess the potential strength and value of the relevant patent(s) across three metrics: (a) patent strength, (b) encompassed technology, and (c) market indicia. The information from the Technical Evaluation is used to support or inform the Financial Valuation. For those with large patent portfolios who are on a budget and unsure of what their key IP assets are, we suggest performing standalone Technical Evaluations, which can be used to informatively guide what next steps to take in evaluating, developing, or monetizing such assets.

Financial Valuation Tier 5
Summary: Tier 5 is a more thorough analysis relative to Tier 4 and therefore includes the services described in Tier 4 but is further augmented. Specifically, this tier is highly customizable to meet the client/patent owner’s exact needs. For example:
- If the client/patent owner is interested in understanding the range of potential values associated with licensing their patented technology, a thorough analysis of such licensing activities (be it through an arms-length transaction or a litigation model) and associated costs and timing will be evaluated and incorporated into the valuation model.
- If the client/patent owner is interested in understanding whether potential design-arounds (non-infringing alternatives) to the patented invention exists, the report can be tailored to focus on the technical merits of the patented technology while also considering the costs associated with any potential design around costs.
- If the client/patent owner is interested in understanding the value associated with a contemplated patent pool and licensing share of revenue for each patent contributor, the report can be tailored to focus on the relative strength of each contributing patent and the value of the pooled patent assets.
- If the client/patent owner is interested in partnering with a third party to incorporate their patented technology in future products, the report can be tailored to focus on the licensing value of the technology (and potential know-how) as well as identifying potential partners.
Throughout the valuation process, there will be ongoing correspondence and status meetings with the client/patent owner to ensure all ground is covered and relevant feedback is incorporated.
Use Cases: This tier is recommended for clients/patent owners seeking an in-depth report and highly customizable services to fit their specific needs. This tier is also structured and crafted for internal and external consideration (see deliverables below).
Deliverables: A thorough report which includes descriptive write-ups of the (a) subject patent(s), (b) relevant industry and/or market segments, (c) relevant Total Available Market (“TAM”), (d) Income Approach analysis, including comparable royalty rate indicators, (e) discount rates and risk adjustments, (f) Market Approach analysis, including identified comparable market transactions, (g) Cost Approach analysis, including identified value indicators, (h) a conclusion of value for the subject patent(s), and (i) any additional custom analyses as requested. All relevant materials, data, and the valuation model will be provided as part of the final deliverables. We will conclude the project with a meeting to discuss the key findings of the report and answer any questions. A Tier 5 Technical Evaluation is also included.
